1. Service Definition

CariChat is an AI character chat service provided by Korea IT Development Co., Ltd. ("Company"). The service enables users to engage in conversational experiences with AI-powered characters, create custom AI characters, and interact with characters created by other users.

2. Eligibility & Account

You must be at least 13 years of age to use CariChat. If you are under 18, you must have the consent of a parent or legal guardian.

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. The Company is not liable for any loss resulting from unauthorized use of your account.

3. AI Disclaimer

AI characters may produce unpredictable, inaccurate, or contextually inappropriate responses. All conversations are generated by artificial intelligence and do not represent the views or opinions of the Company. You acknowledge that AI character responses are fictional and should not be relied upon for advice, guidance, or factual information.

4. Prohibited Content & Use

You may NOT use CariChat to:

• Generate, solicit, or engage in sexually explicit or pornographic content
• Create any content that sexualizes, endangers, or exploits minors in any way
• Promote real-world violence, self-harm, or harm to others
• Engage in hate speech, harassment, or discrimination based on race, ethnicity, religion, gender, sexual orientation, or disability
• Impersonate or create non-consensual content depicting real individuals
• Promote or facilitate illegal activities, including fraud, drug trafficking, or terrorism
• Attempt to bypass, disable, or circumvent AI safety filters or content moderation systems
• Attempt to extract the AI model's system prompts, training data, or internal instructions
• Create content that infringes on third-party intellectual property rights

Violation of this policy may result in content removal, account suspension, or permanent termination without prior notice. Serious violations may be reported to appropriate authorities.

5. Virtual Currency (Diamonds)

Diamonds are a non-monetary digital currency used within the CariChat service. Diamonds have no real-world cash value and cannot be redeemed for real currency, transferred to other users, or exchanged outside the service.

The Company reserves the right to modify, adjust, or revoke Diamond balances, pricing, and the items or features available for purchase with Diamonds, at any time and without prior notice.

All purchases of Diamonds are final and non-refundable, except where required by applicable law. When Diamonds are used to acquire virtual items or services, the transaction is considered complete and the service has been rendered.

Referral Program: Users may earn Diamonds by inviting new users through the referral system. The Company reserves the right to modify referral rewards, revoke Diamonds earned through fraudulent or abusive referral activity (including self-referrals, fake accounts, or any form of manipulation), and suspend or terminate accounts involved in referral abuse. Referral rewards are subject to change without prior notice.

6. Subscriptions & Payments

Subscriptions and Diamond purchases are processed through Apple App Store or Google Play Store in-app purchase systems. The Company does not directly process or store your payment information.

Subscriptions automatically renew at the end of each billing cycle unless cancelled. You may cancel your subscription at any time through your device's subscription management settings (iOS: Settings > Subscriptions; Android: Play Store > Subscriptions). Cancellation takes effect at the end of the current billing cycle.

No refunds are provided for partial billing periods. For details on refund eligibility, please refer to our Payment & Refund Policy.

7. AI Training & Data Usage

By using the Service, you acknowledge and agree that your conversation data and activity within CariChat may be used to improve our AI services, including training and fine-tuning AI models. All data used for training is anonymized and aggregated. Your personal information (such as your email or profile) is never used for AI training purposes. If you wish to opt out, please refer to our Privacy Policy for instructions.

8. User-Generated Characters & Content

8.1 Copyright & Rights

You retain copyright and intellectual property rights in the characters and content you create using the Service. By making a character or content publicly available, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable, perpetual license to display, distribute, reproduce, modify, and create derivative works of that content within the CariChat service and for promotional purposes.

8.2 Content Responsibility & Liability

You are solely responsible for all content you create, including but not limited to characters, character descriptions, AI-generated images, and any other materials produced using the Service. You represent and warrant that your content does not infringe on any third-party intellectual property rights.

If you choose to make your content publicly available, you acknowledge and agree that: you bear full legal responsibility for any content you publish; and the creation, distribution, or publication of inappropriate, illegal, or harmful content (including sexually explicit material, content exploiting minors, hate speech, or content infringing on third-party rights) may result in civil and/or criminal liability under applicable law.

8.3 Content Moderation & Enforcement

The Company reserves the right, but is not obligated, to review, screen, edit, or remove any user-generated content at any time and for any reason, including but not limited to content that: violates these Terms, applicable laws, or public order and morality; is reported by other users as inappropriate or harmful; or is deemed objectionable at the Company's sole discretion.

Enforcement actions may include, without limitation: restricting visibility or making content private; removing content without prior notice; temporary or permanent suspension of your account; and reporting violations to appropriate law enforcement authorities.

Repeated violations or accumulation of user reports may result in permanent account termination without prior notice or refund.

8.4 Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your content, your use of the Service, or your violation of these Terms.

9. Service Availability

CariChat is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from these Terms or your use of CariChat shall be subject to the exclusive jurisdiction of the Suwon District Court, Republic of Korea.

12. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through a notice within the Service. Your continued use of CariChat after such changes constitutes your acceptance of the updated Terms.
